Three roomates neglected to show for work and open the business. They are supervisors and tenured staff (all hourly). When their manager gave them a written warning for their action and clear lack of ownership for the role, they offered a written rebuttal and are claiming discrimination for being "roomates" and feel unjustly wronged claiming that they gave the required "four hour" window to call in 'sick.'
The fact that we were unable to open for business, lost two hours of sales and productivity and rely on them as supervisors and leaders, we feel the written warning and 90 day probation is just. They want to involve the EEOC. Is this even something to worry about?

It's something to worry about if the three are smart enough to allege they all were sick with the same contagious condition.

It would be very hard to refute that.

My suggestion: change and stagger their schedules.

Also impress upon all employees that when no one shows up, business does not transpire. When business does not transpire, employment cannot.
